Election Update 30 Dec 2:50 pm

ODM just finished a press conference, William Ruto spoke missed it because was hanging out at the pool with baby but baba took notes for me (my poor family!)

– ECK is supposed to verify by 3:00 pm

– Results in 48 constituencies have issues. The results announced are not the ones on the form 16A that were signed by ALL party agents.

– Examples of discrepancies – Kandara 16 A figures are 33,825 vs announced figures 70,443; Mwea 16 A figures 62,374 vs 82,374; I. South 45,029 vs 60,050.

– ODM’s total figures as announced by Ruto 4,215,437 Raila vs. 3,748,261 Kibaki.

Nothing yet from PNU/government. This is very very irresponsible and if anything Kibaki should be the one out there appealing for calm. Serious allegations have been made and in my view it is incumbent on them to be out there lowering the temperatures.

The most beautiful thing about Dec 27 was that Kenyans from all over Kenya came out to vote peacefully – IF – the government/incumbent has in some way attempted to tamper with this process it will be a sad day for Kenya and very very short-sighted. If that is indeed the case – and I reiterate that it is not verified, I think Kibaki should concede for the sake of the country and avoid putting us in recount hell.

For those who are asking, Kibaki has not agreed to a recount.

Election Update 30 Dec 1:45 pm

Still no word from the ECK. Absolutely nothing. This is outrageous. Even if they can’t announce they results yet, someone should come in and give a timeline or explain what is going on. The lack of information flowing from them is just unacceptable.

Temperatures are rising again.

Manu Chandaria has spoken for the business community and appealed for calm while results are announced. Francis Atwoli has also called for calm and asked for the government to assure people of their security, specifically the Minister for Internal Security and the A-G.

Nothing yet from PNU. Though Kibwana and Kombo just made some off-the-cuff remarks to the press asking for calm and asking ODM to stop intimidating the ECK (me thinks they are angling for nominated positions after being sent home). Raila also just spoke again outside KICC appealing for calm among his supporters, and toning down his rhetoric about what happens if the elections are indeed rigged – he said Kenyans will decide.

Election Update 30 Dec 11:15 am

Raila just got done with a press briefing. Here are the main points:

– Started off by appealing to his supporters to be patient while they await a honest count of the vote and to respect the rule of the law.

– Said that the government has lost legitimacy based on the results and that Kibaki shouldn’t govern if he respects the people. Said that the parliamentary results confirm that Kenyans have no confidence in him. Asked him to be a gentleman and concede defeat.

– Has asked for a full recount to be held in view of media and observers. Does not trust the audit that went on last night at KICC. Said that commissioners are being influenced by the government to doctor results.

– Gave an example of Juja constituency whose figures announced by the ECK had changed three times – started at 70k, now a 100k.

– He said that the form 16A results are not tallying up with the results announced by the ECK in a number of constituencies including Gatanga, Nithi and Kiambaa. – Raila said it was possible to “salvage the situation and avoid plunging the country into chaos” with a transparent audit of the results.

– He said he will not accept a Kibaki win without a recount.

During the Q&A

– He said the courts were not an option, because they will not be impartial.

– When asked about the figures he was challenging, he wondered how he could have only gained 100,000 votes while Kibaki gained 400,000 votes from the additional constituencies when just two of the constituencies in the tally – Sotik and Alego Usonga could have given him 100,000 votes – where are the additional votes and why isn’t the media doing the math.

– When asked where he thought the doctoring was taking place, he said at the ECK top level and not at the constituencies because agents from all sides had confirmed results at the constituency level (except in the ares where there was chaos).

– He said that ODM have sources within the ECK who are not happy with the fact that they are being asked to doctor and who are leaking info.

– He claimed that Kajiado North was openly rigged, as of yesterday Sakuda was leading with 25k votes, but as of this morning Saitoti won by 20k votes. Sakuda and his agents not allowed to witness the whole process.

– When asked about the fact that he had declared himself the winner. He said that he was “not trying to do an Abiola in Kenya” if he loses fairly he will accept the results, but “the people of Kenya” will not accept rigged results.

– Asked what he will do if the ECK refused to do a recount, he said they will cross that bridge when they get there.

– He said that if Kivuitu is being forced to doctor the results he should resign rather than plunge the country into chaos.

– He again asked his followers to be peaceful (in Swahili) and said that we are all Kenyans and we should protect the country. He told his followers to avoid looting, breaking the law, and harassing those who did not support him. He said that everyone has a right to exercise their rights, even those who didn’t vote for him and asked people to be patient and wait for the results.

– He said that even if they have a majority in parliament (ODM has 100 seats right now), Kibaki will do what he did after ’02 and the referendum and co-opt ODM guys into his government.

– He used Ivory Coast as an example of where things could go based on a “small mistake” (which I thought was very very inflammatory).

No word on whether PNU will respond.

For the anxious folks – there’s no news until tomorrow. No data, no results, nada. TV programming is back to normal – movies, soccer etc.

Unfortunately, innuendo and rumors will fill in the gap between then.

Guys, please keep your comments clean until then and avoid baiting. I understand that all of you are supporting one side or another, but I don’t want my blog to degenerate into a place filled with rabid and hateful commentary on side or another – this is not a debating zone!

Election 2007 Dec 29 9:00 pm update

First, some housekeeping.

For those who’ve addressed me as Mr., Mister, “man”, “brother” etc. – I know si kwa ubaya but please note that I am female – it is important for me to fight stereotypes against women.

Second, I’m a bit miffed that this whole fiasco has jettisoned the family’s plans to go to Naivasha tomorrow I need a break from Nairobi:-(

On to election news.

As has been stated by the guys in the comments section, nothing further from the ECK until tomorrow morning. Some people think this will lower the temperatures, I think it will only get worse. Although some of us might actually sleep without worrying about whether we are missing a big story.

ODM is challenging figures in Tigania, North Imenti and Kiambaa. PNU also has numbers they want to challenge but don’t have the details so far.

And since there are no more official results, you’ll have to endure my storos :-)

Regarding the ECK, I don’t doubt that Kivuitu is trying to do the best he can, but I have some questions.

With all this confusion about who has the correct numbers, aren’t there like enough guys at the polling station from all parties to confirm when results are read there? This is what the media and the different parties are announcing as provisional results (the fact that all of these guys also have their own numbers is also problematic – si all party agents have to agree to the results before they are announced at the station). Weren’t these results then forwarded to the ECK as provisional results immediately, pending confirmation by the returning officer at KICC? Where then is the discrepancy in numbers between the provisional numbers and the results announced by the ECK coming from? And why is this issue only now being examined after it was raised by individuals from the various parties at today’s press conference? I only expect issues in places like Kajiado North where the counting stopped. And then there is the discrepancy between MP results and Presidential results – one constituency had 30,000 vote for the MP two days ago and then almost 100,000 for the President today – and unless one has been meticulously tracking these numbers things can slip through given the lag between parliamentary results and presidential results even though they were presumably counted AT THE SAME TIME.
Finally, when it was apparent that there were delays from the constituencies why not dispatch some commissioners to fly around in helicopters and find out what is going on on the ground rather than sit at KICC to read results?

I’m just saying.

It is one thing for Kivuitu to state that he will not be bullied into announcing fake results, but yet another for him and the ECK to let things degenerate to this point. His statements that the aggrieved can go to the courts is disingenuous – I respect the rule of law (I am after all a lawyer), but show me an election petition in Kenya that has been resolved in less than at minimum a year (and what with Kibaki’s court packing two weeks ago?).

I’m not really concerned about who wins – I performed my civic duty and voted, but I think either way Kenyans have been presented with a false choice for their president – bado mapambano all around. What concerns me is that the process might have been tampered with after such a fantastic turnout, engagement by the youth and the beginnings of a vote based on performance. Can Kenyans be convinced to trust the process again in 2012? And are any of these leaders thinking ahead about the future of the country? The answer sadly is no and now I’m feeling doubly depressed.

I think I need a glass of wine.

Election 2007 Dec 29 6:15 pm update

The latest ECK briefing just got down. The briefing was very chaotic, with lots of interruption, ODM claimed that the Nithi numbers had changed 3 times each time getting higher and that the results don’t tally with what their presiding officers had on the ground – no time to go into the nitty gritty. It is important to note, however, that everyone got their say and there was a candid exchange with Kivuitu. Kivuitu reiterated that he will not be bullied by any side into submitting false results.

I also want to emphasize left by a commenter that the vast majority of Kenyans are sitting tight and waiting for the results – not sure what you guys are seeing on western media but things are not falling apart (yet). I really really hope that the leaders on both sides come out and urge restraint because things could easily spiral out of control.

This one is a cliffhanger guys.

Latest results: Kibaki 3,842,051 Raila 3,880,053 with 180 constituencies in. ODM guys looked stunned and huddled immediately afterwards.

Election 2007 Dec 29 3:15 pm update

– I am concerned about reports of poor reporting and ethnic baiting by stations in the rural areas, especially vernacular stations – tensions are high enough as it is.

– I agree with the commenters who say that Kivuitu should have been more responsible during the press conference, his cavalier attitude when people are didn’t help things though I think it was more of a cover your ass strategy – the more the commissioners distance themselves from what is going on in the field, the safer they are from accusations of tampering with the results.

– Demos reported in Migori, Kisumu, Eldoret, Mombasa and Kakamega.

– The foreign observer press conference just ended, they have refused to judge the process before the results are officially announced and have urged for restraint.

– Kamkunji returning officers are AWOL with the official tally.

– North Horr: Ukur Yattani out.

– Tally of seats by party: ODM 93, PNU 33, ODM-K 15, KANU 9, SAFINA 5, NARC 3, NEWFK 2, SISI 2, NARC-K 2

– Both parties have declared themselves winners of the elections. I think this is highly irresponsible, ODM started off first with Mudavadi reading the statement and forcing PNU to respond. What they both should have been doing is urging calm and restraint among their supporters until the process is concluded- after all these are the guys who’s lives are coming to a standstill (stores closed, no public transport, fear etc) and paying for the violence with their lives, while Kibaki and Odinga are safely ensconced wherever they are.

– ODM is reporting the following numbers: Raila 4.2, Kibaki 3.7,
– PNU is reporting the following numbers: Raila 4.2, Kibaki 4.5
